WHAT IS SEXUAL ORIENTATION DISCRIMINATION?
Sexual Orientation discrimination occurs when an employer discriminates against an employee because of their actual or perceived sexual orientation. Sexual orientation discrimination is illegal because it necessarily falls within the category of sex discrimination. If an employer discriminates against a homosexual employee the employer intentionally penalizes a man for being attracted to a man or a woman for being attracted to a woman. Thus, the discrimination is based, in part, on the sex of the employee.
